Privacy Statement for Livity AS

This is Livity AS's privacy policy, which provides you with information about the use of the service as well as what personal data we collect, how we process your personal data and your rights related to the processing of your personal data.

1. About Livity AS

Livity AS is a service that provides digital health care in preventive health. Through Livity AS, you can get digital doctor consultations and receive health advice, based on information that you provide to us. Livity AS has Org.nr. 934 583 175 (hereinafter “Livity”, “we” or “us”).

In this privacy statement you will find everything you need to know about how we process your personal data when using Livity. We will tell you what information we collect, how we use it to deliver content and services, and what choices and rights you have in this process.

2. Responsibility for the processing of personal data

Responsibility for the processing of personal data when using Livity is governed by the General Data Protection Regulation (GDPR), the Personal Data Act and the Swedish Health Personnel Act. Livity AS is the controller for the processing of personal data, which means that we have the primary responsibility for ensuring that the processing of personal and health data complies with the applicable regulations.

However, we note that Livity is not the data controller for any medically required health data processed in connection with your use of our services. This responsibility rests with the individual doctor. Requests for access to patient records may nevertheless be directed to Livity, who will pass the claim on to the responsible physician.

3. Collection and use of personal data

A) General information on the collection of personal data

When you use Livity for health advice, we collect information about your health status and other relevant circumstances such as age and gender by answering the questions in our online solution. We only ask questions that are necessary and relevant in relation to the services we provide to you. Answering the questions is voluntary, but if you do not provide us with sufficient information, we will not be able to provide healthcare to you.

B) Use of personal data to provide services and goods.

We process personal data to deliver goods and services to you. This includes the collection and use of health data and other information that we pass on to the attending physician in order to provide health care in accordance with the agreement we have entered into with you. The legal basis for this processing is to fulfil the agreement with you, cf. GDPR Article 6 (1) (b) and Article 9 (2) (h).

C) Use of personal data for statutory purposes

We process personal data to fulfill obligations we are required to do by law. This includes the obligation to keep accounts, cf. Section 2 of the Bookkeeping Act and the obligation to safeguard information security, cf. GDPR Article 32 and Patient Records Act 22. The legal basis for this processing is to comply with legal requirements, cf. GDPR Article 6 (1) (c) and Article 9 (2) (h).

D) Use of Personal Data to Quality Assurance and Improve Livity

Livity may process your personal data, including health information, in order to quality-ensure and improve our services. This allows us, for example, to qualitatively ensure that information provided by Livity to physicians and healthcare providers is accurate and appropriate. The data will also be used to train and further develop the advanced medical algorithms on which Livity is based. This allows us over time to offer ever better versions of Livity to the delight of both patients and physicians.

The legal basis for this processing is consent, cf. GDPR Article 6 (1) (a) and Article 9 (2) (a).

E) Use of personal data for marketing

We process certain information for marketing purposes. This does not include any health information you have provided to us. For example, we may send you an email reminder if you have started but not completed an abandoned cart or other information relevant to the customer journey.

Information that you are registered as a user of Livity, unrelated to specific health information, is not classified as sensitive information. Reminders and general customer communications can therefore be sent by e-mail and SMS without special consent, provided that this is done within the framework of an existing customer relationship and you have not reserved any such communication.

We may also use cookies for marketing purposes, for example to show you marketing on social media. The legal basis for this processing is consent or our legitimate interest in marketing our services, cf. GDPR Article 6 (1) (a) and (f), depending on the type of marketing in question.

F) Use of personal data for statistics, analysis and research

Livity AS collects and may use anonymized and aggregated information for statistics, analysis, quality assurance, documentation and to improve our services. Such data can also be used for research and development purposes in preventive health. We may share aggregated and non-identifiable data with research communities, partners or other third parties, when relevant to the development and documentation of healthcare services. The information can never be linked back to you as an individual.

The legal basis for the processing is our legitimate interest in understanding the use of our services, cf. article 6 (1) (f) GDPR.

In exceptional cases, we may process your personal data for other statutory purposes (for example, by order from the courts, the police or others if such orders preempt the duty of confidentiality in the Health Care Act), or if the disclosure is necessary to safeguard our legitimate interests in connection with a transfer of business or in clarifying, defending or establishing legal claims. We will notify you of such processing to the extent that this is reasonable and practicable.


4. Sharing and Transfer of Personal Data

We use subcontractors to help us fulfill the agreement we have with you or perform other tasks on our behalf. These subcontractors only have access to information that is necessary for the assignment they perform for us. In order to protect your privacy, such subcontractors are contractually obligated not to use information for purposes other than to perform the assignment for us, to delete data when the assignment is performed, and to have both technical and organizational measures to protect the information from unauthorized use and disclosure.

Full list of subcontractors can be submitted upon request, but includes, among others:

  • Pridok - Medical Record Systems Providers
  • Fürst - handles laboratory tests and answers
  • MaiaMD - platform for interpreting and sending sensitive information to patients
  • TidyCal - booking system

In addition, we will only disclose personal data about you to third parties in statutory cases (for example, by order of the courts, the police or others), or if the disclosure is necessary to safeguard our legitimate interests in connection with a business transfer or in clarifying, defending or establishing legal claims.

5. Your rights

Norwegian and European legislation gives you additional rights to help you safeguard your privacy. These rights include:

  • Access: You have the right to request access and/or a copy of your personal data
  • Correction: You may request that incorrect or incomplete information about you be corrected
  • Deletion: You may, in certain circumstances, request that your personal data be deleted from our systems
  • Restriction: You can request that the processing of your personal data be restricted
  • Objection: You have the right to object to the processing of your personal data when the processing is based on Art. 6 (1) (f) GDPR
  • Data portability: You can request that your personal data be transferred to another organization in a structured, common and machine-readable format.
  • Consent: You can withdraw consent to the processing of personal data that you have provided to us.

6. Security of the processing of personal data

We have implemented the necessary security measures to ensure that your personal data is processed in a secure manner that ensures the confidentiality, integrity and availability of the information. The security measures shall also protect the data against unauthorised or unlawful processing, as well as mitigate the risk of loss, accidental alteration, unauthorised dissemination or disclosure.

7. Changes to the Privacy Policy

This Privacy Policy is subject to change over time. We encourage you to regularly review this Statement to be up to date on how we collect, use and protect your information.

8. Data protection officer and contact information

Livity is committed to protecting the privacy of our users and has therefore appointed a Privacy Officer. The Data Protection Officer is responsible for ensuring that all processing of personal data through Livity is carried out in accordance with applicable data protection legislation, including the GDPR. The Data Protection Officer also acts as a point of contact for you as a user, if you have questions, concerns or wish to exercise your rights related to personal data.
